Delinquent taxes

Quick answerDelinquent taxes are property taxes that remain unpaid after their statutory due date. Delinquency triggers penalties and interest, the recording of a tax lien, and — on timelines set by each state — the tax sale process itself. Every concept in this glossary begins with a delinquent tax bill.

The road from delinquency to sale is statutorily paced. California property becomes subject to the power of sale after five years tax-defaulted (three for nonresidential commercial and nuisance-lien property); Arkansas parcels are certified to the Commissioner of State Lands after one year delinquent, with sale at least two years after certification; Michigan returns taxes delinquent March 1, forfeits them the following March 1, and forecloses in the third year.

For investors, published delinquent lists are the earliest deal signal — they precede sale lists by months. For owners, delinquency is the cheapest moment to fix the problem: penalties compound, and every later stage (lien sale, foreclosure, deed) is more expensive than the tax bill was.

Delinquency is also a research timeline. The delinquent list is published before the sale list, which means the investable universe of a sale is knowable months ahead — owners who will cure, parcels that will be pulled, and inventory that will survive to auction reveal themselves progressively. Professionals track delinquent parcels the way other investors track earnings calendars: not because delinquency itself is buyable (in most states the sale is the entry), but because preparation compounds. For owners reading this glossary defensively: delinquency is cured cheapest at this stage — the tax bill plus penalties — and every subsequent stage transfers value away from you: to certificate holders as interest, to deed buyers as discount, to attorneys as fees.

In practice: Mississippi counties sell on the last Monday in August for the year's delinquencies; Missouri's annual sale falls on the fourth Monday in August (RSMo 140.170); Kentucky clerk sales of certificates of delinquency run mid-July through October.
